General Terms and Conditions (GTC) of Xyra.Swiss
1. Scope
These GTC apply to all orders placed through the Xyra.Swiss online shop.
Sales are exclusively to private individuals residing in Switzerland or Liechtenstein.
Consent
By placing an order, you agree to these GTC.
Deviating conditions
Other purchasing conditions or terms and conditions from you as a customer can only be considered if we confirm them in writing.
Partial invalidity
Should any provision of these GTC be invalid, the effectiveness of the remaining provisions shall remain unaffected.
Legal basis and jurisdiction
Swiss law (OR – Code of Obligations) applies. The exclusive place of jurisdiction for all disputes arising from the contractual relationship is, as far as legally permissible, the domicile of Xyra.Swiss in Switzerland.
2. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but an unbinding invitation to order.
By submitting the order, the customer makes a binding offer to conclude a purchase contract.
The automatic order confirmation by email does not yet constitute acceptance of the offer.
The contract is concluded by:
· an explicit order confirmation by email or
· the dispatch of the goods
3. Delivery and shipping
Delivery area
Delivery is exclusively within Switzerland and Liechtenstein.
Shipping costs and shipping methods
Xyra.Swiss offers the following shipping options:
Standard shipping (B-Post): free, standard selection
A-Post: depends on the weight of the products
Saturday delivery: depends on the weight of the products
Express delivery: fixed price
Self-collection: free, possible directly at Xyra.Swiss location by arrangement.
Shipping is carried out by external service providers.
Delivery times
Standard delivery time: usually 2–4 working days
The indicated delivery times are non-binding guidelines and do not represent guaranteed delivery periods.
Delays can occur, particularly in cases of increased demand, supply bottlenecks, or external delays.
Transfer of risk
The goods pass to the customer upon handover to the carrier.
4. Prices
All prices are stated in Swiss Francs (CHF).
Xyra.Swiss is not subject to VAT as a small business, therefore no VAT is shown.
Price changes, as well as errors and incorrect price information, are reserved.
5. Payment methods
· Credit and debit cards (Mastercard, Visa, Maestro, V PAY)
· Apple Pay
· Instant bank transfer (Klarna)
· Klarna (invoice / installment payment, if available)
· EPS
· PostFinance
· TWINT
· Bank transfer (prepayment)
For payment by bank transfer (prepayment), the invoice amount must be transferred within 14 days of ordering. If payment is not made within this period, we reserve the right to cancel the order.
6. Default of payment
In case of default of payment, we reserve the right to withdraw from the contract.
Default interest of 5% per annum will be charged. In addition, dunning fees of up to CHF 25.00 per reminder may be charged.
Outstanding debts may be assigned to third parties (e.g. collection service providers).
7. Right of return
We grant a voluntary right of return of 14 days from receipt of the goods.
Conditions:
· unused
· undamaged
· original packaging
· originally sealed
· not opened
· prior notification of the return
Once a product has been opened or unsealed, returns are excluded.
The customer bears the return shipping costs.
The return address will be communicated after prior notification. The shipping receipt must be kept.
8. Warranty
The statutory warranty rights under Swiss law apply.
Obvious defects or transport damage must be reported within 24 hours of receipt of the goods.
The report must be made via the contact form and must contain the following information:
· description of the defect
· order number
· meaningful photos of the affected goods
Our team will review the report and decide on the further course of action (replacement delivery, repair or refund). The customer will be informed of the next steps as soon as possible.
If the report is not made within this period, we reserve the right to refuse or limit processing, insofar as this is legally permissible.
The customer is obliged to check the goods immediately upon receipt.
9. Liability
Xyra.Swiss accepts no liability for damages resulting from improper use, incorrect handling or natural wear and tear of the products.
Xyra.Swiss accepts no responsibility for defects or damage that occur after use of the goods. Such cases are generally the responsibility of the buyer.
Returns or refunds are only possible within the conditions defined under point 7 of these GTC.
Liability for slight negligence is excluded, as far as legally permissible.
Liability for intent and gross negligence remains reserved in any case.
10. Data protection
The processing of personal data is carried out in accordance with the Swiss Data Protection Act (DSG).
Personal data will be used exclusively for order processing, delivery and customer service.
The transmission of sensitive data is encrypted (SSL).

11. Place of jurisdiction
All legal relations are subject to Swiss law.
The place of jurisdiction for both contracting parties is Oberengstringen, as far as legally permissible.
